AJSU to knock SC door om triple test

Monday, 08 January 2024 | PNS | Ranchi

AJSU party MP Chandraprakash Chaudhary knock Supreme Court against the Jharkhand High Court's decision on the municipal elections in Jharkhand. In fact, in the case of Roshni Khalkho vs Jharkhand government, the court of Justice Ananda Sen in the Jharkhand High Court ruled that the Hemant Soren government of the state should issue a notification by announcing the municipal elections in three weeks. Meanwhile, Vikas Kishan Gawli vs. Maharashtra government has a clear directive of the Supreme Court in the case that the bodies/panchayats should not be conducted without conducting a triple test. At the same time, the AJSU party says that without triple test, it will be injustice to the backward to hold the municipal elections. Actually, panchayat elections in Jharkhand were also conducted without triple tests.

AJSU party MP Chandraprakash Chaudhary said that "Hemant government intention is not only to give the rights to the backward. A year ago I went to the Supreme Court on the above issue. The Supreme Court has a clear instruction that it is a clear instruction that only after doing a triple test." Bodies/Panchayat elections should be held. The government also imposed affidavit in the Supreme Court that we will conduct triple tests. Three months sufficient for the triple test, despite this the government has not done this till date. In such a situation, the question of the intention of Hemant Soren government raises questions. Like the panchayat, the municipal elections are also done without a triple test, then it will be gross injustice to the backward.”

During the hearing on the municipal elections, the Hemant government, who is presenting the example of Vikas Kishan Gawli vs. Maharashtra government on the triple test, was given the examples of Roshni Khalkho on the Suresh Mahajan vs Madhya Pradesh government case in which the Supreme Court has said that the Supreme Court has said. That triple test is necessary but it is not that elections cannot be conducted. Against this argument, the court of Justice Anand Sen had directed the Hemant Soren government to issue a notification for the municipal elections in 3 weeks. Earlier, AJSU central spokesperson Dr. Devsharan Bhagat also said that it would be injustice to the backward without conducting elections without triple test. This is not acceptable to us.

AJSU MP Chandraprakash Chaudhary said that if it is to be held in 3 weeks, then it should be with a triple test but from a practical point of view it does not seem possible. He said that the government does not intend to conduct a triple test nor to hold the municipal elections.
